DMCA & Copyright Policy

1. Respect for Copyright
TrueFans respects the intellectual property rights of creators and third parties, and we expect our users to do the same. We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act, 17 U.S.C. §512 ("DMCA"), and we terminate repeat infringers in appropriate circumstances.
Content uploaded to TrueFans remains the property of the uploading creator. If you believe your copyrighted work has been copied and is accessible on TrueFans in a way that constitutes infringement, follow the procedure below.
2. Filing a DMCA Takedown Notice
To be effective under the DMCA, your takedown notice must be in writing and include all of the following:
- Identification of the copyrighted work you claim has been infringed (or, for multiple works, a representative list);
- Identification of the infringing material and its location on the platform — please provide specific URLs so we can find it quickly;
- Your contact information — name, mailing address, telephone number and email address;
- A good-faith statement that you believe the use of the material is not authorized by the copyright owner, its agent, or the law;
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf;
- Your physical or electronic signature.
Incomplete notices cannot be processed. Upon receipt of a compliant notice, we will remove or disable access to the identified material expeditiously and notify the uploader.
3. Where to Send Notices
DMCA takedown notices should be sent to our designated copyright agent at dmca@truefans.fun. Please include "DMCA Takedown Notice" in the subject line. Notices sent through other channels may be delayed.
4. Counter-Notification
If your content was removed or disabled and you believe this was a mistake or misidentification — for example, you own the content or have a license — you may submit a counter-notification to dmca@truefans.fun including: (a) identification of the removed material and where it appeared before removal; (b) a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification; (c) your name, address and phone number; (d) consent to the jurisdiction of the federal district court for your address (or, if outside the U.S., for any district where TrueFans may be found) and acceptance of service of process from the original complainant; and (e) your physical or electronic signature.
Upon receipt of a valid counter-notification, we will forward it to the complainant. Unless the complainant files a court action within 10–14 business days, we may restore the material.
5. Repeat Infringer Policy
In accordance with the DMCA and our Terms of Service, TrueFans maintains a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are repeat infringers. We track valid takedown notices per account and may also terminate accounts after a single egregious infringement.
6. Warning About False Claims
Under 17 U.S.C. §512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages, including costs and attorneys' fees. Please do not submit a takedown notice or counter-notification unless you have a genuine, good-faith basis — and consider consulting an attorney first.
