Terms of Service

By accessing, browsing, registering for or otherwise using TrueFans, you acknowledge that you have read, understood and agree to be bound by these Terms, together with our Privacy Policy, Cookie Notice, Refund Policy, DMCA Policy and 18 U.S.C. §2257 Compliance Statement, each of which is incorporated by reference. If you do not agree to these Terms, you must not access or use the platform.

These Terms apply to all users of the platform, including visitors, registered fans, creators and any person who accesses content made available through TrueFans. We may enforce these Terms against any user, and your continued use of the platform after any modification constitutes acceptance of the modified Terms.

TrueFans is an adults-only platform. You must be at least 18 years old — or the age of majority in your jurisdiction, whichever is greater — to access or use the platform. By using TrueFans you represent and warrant that you meet this requirement and that you are legally permitted to view adult-oriented content in your jurisdiction.

We employ age-verification measures, including an age gate and identity verification for creators. We reserve the right to request proof of age at any time and to suspend or terminate any account where we suspect the user is under 18 or has provided false age information. No person under 18 may register, appear in content, or otherwise use the platform in any capacity.

To use most features of TrueFans you must create an account. You may register as a "fan" (a user who subscribes to and purchases content from creators) or as a "creator" (a user who publishes content and receives payments from fans). You agree to provide accurate, current and complete information during registration and to keep it up to date.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use. Creator accounts are additionally subject to identity verification (KYC), including submission of a government-issued photo ID and a verification selfie, before any content can be monetized or payouts issued.

You may not create an account on behalf of another person without authorization, share your account, or create multiple accounts to evade enforcement actions. We may refuse registration or reclaim usernames at our discretion.

Fans may purchase monthly subscriptions to creator profiles, pay-per-view ("PPV") content, and tips. All prices are displayed and charged in U.S. dollars (USD) unless otherwise indicated. Subscriptions renew automatically at the end of each billing period at the then-current price until cancelled. You may cancel a subscription at any time from your account settings; cancellation takes effect at the end of the current paid period, and you retain access until that date.

By providing a payment method you authorize us (through our payment processors) to charge recurring subscription fees, PPV purchases and tips to that method. You are responsible for all charges incurred under your account. Prices for subscriptions are set by creators within platform limits and may change for future billing periods with notice.

Payments are processed by third-party payment processors; TrueFans does not store full payment card numbers. All purchases are subject to our Refund Policy.

TrueFans charges a platform commission of twenty percent (20%) on all creator earnings, including subscriptions, PPV sales and tips. Creators receive the remaining eighty percent (80%) of gross fan payments, less any applicable payment processing fees, taxes, refunds or chargebacks. The commission covers platform operation, hosting, payment processing infrastructure, moderation and support.

We may change the commission rate prospectively with at least thirty (30) days' notice to creators. Continued use of the platform after the effective date of a commission change constitutes acceptance of the new rate.

Creator earnings are paid out weekly, subject to a seven (7) day rolling hold from the date each payment is received. This hold period allows for fraud screening, refunds and chargeback protection. A minimum payout threshold applies; earnings below the threshold roll over to the next payout cycle.

Before any payout is issued, creators must complete identity verification (KYC) and provide valid payout details. We may withhold, delay or reverse payouts where we suspect fraud, Terms violations, chargeback risk or unlawful activity, or where required by law. Creators are solely responsible for all taxes on their earnings; TrueFans does not withhold taxes except where required by law.

Creators retain ownership of the content they upload. By uploading content, the creator grants TrueFans a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, transcode, display, distribute and promote that content on and through the platform for as long as the content remains published, and for a reasonable period thereafter for backup, legal and enforcement purposes.

All content must comply with these rules at all times:

• No content involving minors or persons who appear to be under 18, in any context.
• No non-consensual content, including content uploaded without the documented consent of every person depicted.
• Every person depicted in adult content must be verified as 18+ with government-issued ID.
• No content that is illegal in any applicable jurisdiction, including bestiality, incest-themed content presented as real, or content depicting sexual violence presented as real and non-consensual.
• No content that infringes third-party intellectual property, privacy or publicity rights.
• No content used to facilitate prostitution, human trafficking or exploitation.

We reserve the right (but assume no obligation) to review, remove or restrict any content at any time, with or without notice, where we believe it violates these Terms or applicable law.

You agree not to:

• Use the platform if you are under 18, or allow any minor to access your account;
• Harass, threaten, dox, blackmail or extort any user;
• Scrape, download, record, redistribute or republish creator content without authorization;
• Circumvent paywalls, access controls, DRM or other technical protection measures;
• Use the platform for money laundering, fraud, or unlawful financial activity;
• Impersonate any person or misrepresent your identity or affiliation;
• Upload malware, interfere with platform operation, or probe security vulnerabilities;
• Initiate fraudulent chargebacks or abuse the payment system;
• Use bots, scripts or automated means to interact with the platform except via approved APIs;
• Encourage or facilitate any of the foregoing.

The TrueFans platform, including its design, logos, software and underlying technology, is owned by or licensed to TrueFans and protected by intellectual property laws. Except for content you own, you may not copy, modify, distribute or create derivative works of any part of the platform without our prior written consent.

We respect the intellectual property rights of others and respond to valid notices of copyright infringement under the Digital Millennium Copyright Act ("DMCA"). Our full takedown and counter-notification procedure is described in our DMCA Policy. We terminate the accounts of repeat infringers in appropriate circumstances.

You may delete your account at any time through your account settings. We may suspend or terminate your account, remove content, or restrict access immediately and without prior notice if we reasonably believe you have violated these Terms, created risk or legal exposure for us or other users, or engaged in fraud or unlawful conduct.

Upon termination, your right to access the platform ceases immediately. Pending creator payouts may be withheld pending investigation of the conduct giving rise to termination. Provisions that by their nature should survive termination — including licenses for enforcement purposes, disclaimers, limitation of liability, indemnification and dispute resolution — survive.

TrueFans is a hosting and payment platform. Content is created and published by independent creators, not by TrueFans. We do not endorse, control, or assume responsibility for creator content, creator conduct, or interactions between users, whether online or offline. Any dealings between fans and creators are solely between those parties.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUEFANS AND ITS OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM.

IN ALL CASES, OUR AGGREGATE LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO TRUEFANS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

You agree to indemnify, defend and hold harmless TrueFans, its affiliates, officers, directors, employees and agents from and against any claims, liabilities, damages, losses and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your content or conduct on the platform; (b) your violation of these Terms; (c) your violation of any law or the rights of any third party, including intellectual property, privacy and publicity rights; and (d) any content you upload depicting other persons without their valid consent or verification.

These Terms are governed by the laws of the jurisdiction in which TrueFans is incorporated, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the platform shall be resolved by final and binding individual arbitration, rather than in court, except that either party may seek injunctive relief in court for intellectual property or unauthorized-access claims.

YOU AND TRUEFANS EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION OR OTHER REPRESENTATIVE PROCEEDING. Where this waiver is not enforceable, the dispute shall be heard in the competent courts of our jurisdiction of incorporation.

We may modify these Terms from time to time. When we make material changes, we will post the updated Terms on this page and update the "Last updated" date, and where appropriate provide additional notice (for example by email or in-platform notification). Changes take effect upon posting unless stated otherwise. Your continued use of the platform after the effective date constitutes acceptance of the revised Terms. If you do not agree, you must stop using the platform and close your account.
